Terms and Conditions of music workshops “Open Minded Drum Camp” in 2019

§1 The Workshops

1. The organizer of Open Minded Drum Camp percussion workshops in 2019. (hereinafter referred to as these Workshops) is OPEN MINDED CREATIVE SOLUTIONS LIMITED 11101075, 85 GREAT PORTLAND STREET, FIRST FLOOR, W1W 7LT LONDON, GREAT BRITAIN.
2. The workshops that are dedicated to people that play drums will be held at Miejskie Centrum Kultury, Al. Wolności 4, 34-300 Żywiec from 3-8 of August 2019.
3. A detailed program of the workshops, taking into account, in particular, the schedule for each day of the workshop, was posted on the website: https://openmindeddrumming.com/en/info-and-program/ and https://openmindeddrumming.com/en/daily-schedule/
5. The main goal of the Workshops is to improve the drumming skills of participants of the Workshops, as well as motivating for further artistic development.

§2 Conditions for participation

1. Participants of the workshops may be adults or, with the written consent of the parents or legal guardian constituting Appendix No. 1 to these Terms and Conditions, minors who have completed 13 years of age.
2. Participation in the Workshops is paid.
3. The number of places at the Workshops is limited, and participation is determined by the order of applications, in accordance with the provisions of these Terms and Conditions.
4. The deadline for applying for the Workshops is 01/07/2019. Applications sent after the indicated date will be considered only if places are available.
5. The fee for participation in the Workshops is:
a. 360 EUR if submitting the application by 01/04/2019
b. 420 EUR in the case of applying after the date specified above in the point a.
6. The fee for participation in the Workshops may be paid in one or two installments, the first installment in the amount of EUR 100 and the second installment constituting the appropriate fee specified above in paragraph. 5 minus the amount of the first installment.
7. Applications for participation in the Workshops should be sent via the website openmindeddrumming.com. The application should include the Participant’s data required in the form, as well as the method of payment (either one or two installments). In the case of minors, applications are made by parents / legal guardian. Reports made directly by minors will not be considered.
8. After applying in the manner specified in paragraph 7, within 7 days from the date of sending the application, however not later than the deadline for submitting the applications referred to in paragraph 4, the Participant is obliged to pay the due fee or its first installment (depending on the chosen method of payment). In the event of failure to pay the fee or the first installment in accordance with the provisions of this paragraph, the application shall be considered as not made. The date of crediting the Organizer’s bank account is the date of payment.
9. If the payment option indicates two installments, the entire fee must be paid by 01.07.2019. No payment within this period of the total amount will indicate the resignation from participation in the workshops with expiry of the deadline for settling the remaining part of the fee.
10. In the event of resignation from participation in the Workshops:
a. until 31.01.2019 – the Organizer will return to the Participant the entire amount actually paid;
b. in the period from 01.02.2019 until 31.05.2019 – the Organizer will reimburse the actually paid amount minus the first installment – 100 EUR
c. after 01.06.2019 – the fee paid for participation in the Workshops is not refundable in any part, with the proviso that the Organizer allows the Participant to indicate a new participant who will take the place of the current Participant, with the settlement of the whole payment and fulfillment by the newly designated Participant of all requirements of the Terms and Conditions and its full acceptance.
11. The condition for the Workshops to be held is to register at least 35 Participants who meet the conditions set out in these Terms and Conditions. In the case of a smaller number of Participants, the Organizer may decide to conduct the Workshops despite the smaller number of Participants. If the required number of Participants is not reported, the Organizer will notify Participants not to attend the Workshops and, within 14 days from the date of notification, return to all Participants (to the bank account indicated by them) all funds actually paid by them.
12. The fee for participation in the Workshops covers only participation in the training classes, detailed in the Workshop schedule at https://openmindeddrumming.com/en/daily-schedule/, including the right to enter the final concert. Therefore the cost of meals, accommodation, insurance for Participants, as well as the cost of care for minor Participants of the Workshops outside of the training classes, as items not covered by the Workshops, are not included in the payment for the Workshops and should be covered by the Participants on their own.
13. Each Participant will receive from the Organizer a package of training materials and a diploma of participation in the Workshops.

§3 Duties, rights of the Participant and the Organizer

1. All of the costs related to insurance, travel, stay at the Workshops, including in particular the costs of accommodation and meals, each participant should cover on their own.
2. A prerequisite for participation in the training classes as part of the Workshops is that the Participant owns his own foot pedal and sticks. Without these tools the Participant will not be able to participate in classes.
3. The Participant of the Workshops is obliged to comply with the instructions of the training instructors and the Organizer and to actively participate in the classes.
4. Participants are obliged to immediately notify the trainer or the Organizer in case of any defects in the rooms in which they reside, as part of the Workshops.
5. During the course of the training, each Participant is obliged to comply with health and safety provisions and fire prevention regulations of the place where the Workshops are held.
6. During the training classes as part of Participants’ Workshops, a strict prohibition on alcohol consumption, smoking and the use of narcotic drugs is obligatory.
7. The organizer or lecturer, after a previous warning, has the right to exclude participants disturbing their course or behave in an inappropriate manner from the training activities. Double exclusion from training classes, for reasons referred to in this paragraph, will result in the expulsion from the Workshops without the right to participate in the next training classes and the final concert. In the event of exclusion from training classes or expulsion from the Workshops, the Participant is not entitled to a refund of the fee paid for participation in the Workshops.
8. Participants are not entitled to register training activities (in any way, including audio or video recordings) without the prior written consent of the instructor conducting the training or the Organizer, except for the situation specified in paragraph. 9.
9. The Organizer allows the Participants to record, for their own needs, the course of the Workshops in the form of photographs. The participant is obliged to obtain the consent of other Participants to record and possibly distribute their images on the above photographs on their own.
10. The organizer provides the staff, technical services as well as the Workshop base.
11. The Organizer is not liable for damage to Participants’ property and health arising during the Workshops, and not due to the fault of the Organizer or its employees. Each of the Participants is obliged to insure themselves against all risks, in particular those mentioned above.
12. Participants agree for recording, filming, photographing and recording in any other way the course of the Workshops by the Organizer, including statements of Participants and their performance of musical works.
13. Participants express their free consent to use and to distribute in any way, in particular through social networks and websites, photo/video shots of the Workshops referred to above in order to promote the Workshops and the Organizer. The consent referred to in this paragraph also includes the right to record the reproduction and distribution of images of the Participants, as well as musical works and their artistic performances by the Participants, in the following fields of exploitation, throughout the world:
a. in the area of recording and reproduction of a work – production of a specific technique of a work, including printing, reprographic, magnetic recording and digital technique;
b. in the scope of trade of the original sources or copies on which the work has been recorded – placing on the market, lending or rental of the original sources or copies;
c. in the distribution of the work in a way other than specified in b – public performance, displaying, reproducing and broadcasting and reemitting, as well as making the work available to the public in such a way that everyone can have access to it in a place and time chosen by them.
14. The organizer reserves the right to change, due to important reasons, the program and the schedule of the Workshops, with the reservation that in each case the total number of hours of training classes will not change, in relation to the original Workshop program.

§4 Personal data protection

1. The Organizer of the personal data of the participants of the Workshops is the Organizer.
2. The Administrator collects the following types of personal data of Participants:

a. First and last name of the Participant and parents / legal guardians;
b. addresses of residence
c. date of birth
d. e-mail addresses
e. telephone number
f. personal image
g. bank account number
h. Other data of the Participants required to conduct the Workshops

3. Personal data will be processed by the Organizer in order to: organize and run the Workshops, as well as the promotion of the Workshops and the Organizer.
4. Granting consent for processing personal data and the mere submission of personal data is voluntary, however, consent of processing personal data for all the above purposes is necessary in order to participate in the Workshops.
5. With a separate consent, the Participant may agree for processing their personal data in order to send newsletters and other information about the Administrator’s activities, including the subsequent Workshops, also agreeing to receive these promotional materials. Granting permission to such processing of personal data is voluntary and is not necessary to participate in the Workshops.
6. The participant has the right to cancel their consent for processing personal data at any time, but this will not affect the validity of the data processed before the date of cancelation of the consent.
7. In case of cancelation of the consent, further processing of personal data is possible based on the provisions of applicable law, in particular if it is necessary for the purposes resulting from legitimate interests pursued by the Administrator, in particular to seek the Administrator’s claims, and to use the license granted in accordance with § 3 para. 12 and 13 of these Regulations.
8. Personal data will be processed until the completion of the Workshop and the expiration of the claims resulting from it. Regarding the promotion of the Workshops until the license referred to in § 3 para. 12 and 13 expires.
9. The person that the data refers to has the right to request from the Administrator an access to their personal data, their edit, delete them or restrict their processing. The participant also has the right to request the transfer of data.
10. The person that the data refers to has the right to object to the processing of personal data by the Administrator.
11. The person that the data refers to has the right to lodge a complaint to the supervisory body, which is the President of the Office for Personal Data Protection.
12. The administrator does not make decisions in an automated manner, nor does he uses personal data to profile the person that the data refers to.
13. Personal data will not be transferred to Third States and International Organizations.
14. The organizer will have the right to entrust personal data to entities cooperating with the Organizer during the implementation of the Workshops solely for the purpose of processing personal data in the scope specified in these regulations.
15. In the matter of processing personal data with the Administrator, you can contact us by writing to the address indicated in § 1 of these Terms and Conditions.
16. The administrator does not appoint an inspector of personal data protection.
17. In order to facilitate the Participants of the Workshops to find a shared accommodation with another Participant, the Organizer, with separate consent expressed at the time of filing, may provide the Participant’s contact details to another Participant who also expresses interest in sharing accommodation with another Participant and agrees to transfer their data. The transfer of data is intended only to facilitate Participants to search for accommodation together, and consent to this is not necessary for participating in the Workshops.

§5 Participation of a minor

1. In the case of Participant who is minor, referred to in §2 para. 1 of the Terms and Conditions, it is required to provide the written consent from parents or legal guardians, to the Organizer in accordance with Annex 1 to this contract before the start of the first training classes of the Workshops.
2. The consent referred to in para. 1 of the Terms and Conditions includes the consent for participation of a minor Participant in all training activities specified in the schedule displayed on the website https://openmindeddrumming.com/en/daily-schedule/, as well as in the final concert of the Workshops.
3. Parents or legal guardians of a minor, apart from training classes as part of the Workshops, are obliged to take personal care of a minor or to provide such care through other people. The organizer and instructors do not take care of a minor Participant of the Workshops and are not responsible for the minor Participant outside the training classes.
4. The cost of repairing or removing damage caused by a minor Participant of the Workshops is covered by his parents or legal guardian.

§6 Final Provisions

1. The organizer reserves the right to edit and update the Terms and Conditions for important reasons, in particular if from other reasons not related to the organizer, the Organizer will not be able to conduct the Workshops in the manner specified in these regulations. Each participant will be immediately notified by e-mail about any changes made by the organizer. Within 14 days from the date of receiving the information about the changes in the Terms and Conditions, each Participant has the right to resign from participation in the Workshops, receiving a refund of the entire fee paid.
2. Applying for participation in the Workshops means full acceptance of these Regulations.
3. If it is necessary to cancel the Workshops for reasons beyond the Organizer’s control, he will refund each participant only the actually paid fee. The refund will be made within 14 days from the date of cancellation of the Workshop, to the bank account indicated by the Participant.

5. Regulations come into force on the day of starting acceptance of applications for the Workshops.
